This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioners, who are A1 to A3, in Cr.No.12 of 2018 on the file of the Station House Officer, Lepakshi Police Station, Anatapuram District. The offences alleged are under Sections 324, 354, 304 read with Section 34 of the Indian Penal Code.

Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the respondent.

The case of the prosecution is that all the petitioners committed the offence and there are specific allegations against all the petitioners.

The counsel for the petitioners submits that the third petitioner is an old-aged lady and she may be considered as innocent. 5.

Considering the specific allegations against the third petitioner and also considering that there are allegations against the other two petitioners, that they beat the deceased, this Court is not inclined to grant anticipatory bail to the petitioners. However, the petitioners are at liberty to approach the concerned Court having jurisdiction and seek regular bail. On such bail petition being filed, the concerned Court shall dispose of the same, on merits, on the same day subject to pressure of work.

The criminal petition is dismissed.
