THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.21293 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Standing Counsel for respondent Nos.2 and 3.

The petitioner is a fourth year student of B.V.Sc & A.H course in College of Veterinary Science of the second respondent. She successfully completed three years course. However, when she was attending the fourth year paper-1 of Veterinary Preventive Medicine, she was not allowed due to shortage of attendance as per regulation 9.3 of the SVVU Under Graduate (B.V.Sc. & A.H) Regulations, 2009. Challenging the order dated 23.06.2015 passed by the third respondent, the present Writ Petition is filed.

Regulation No.9.3 of the aforesaid Regulations reads as follows: "9.3. A candidate having attendance below 75% in a paper will not be eligible to appear for the Annual Board examination of that paper."

In view of the above regulation, the attendance of a candidate in each paper will be taken into consideration and when the third respondent noticed that the petitioner did not fulfill the eligible criteria to attend for the said paper, this Court cannot hold that she is eligible to attend the said paper. It is for the academic body to calculate the attendance and this Court cannot direct the academic body to allow the student for examination when petitioner did not produce the required criteria.

The Writ Petition is devoid of merits and the same is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J)
