HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.2188 OF 2017 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code') requesting to quash the proceedings in C.C. No.1 of 2017 on the file of VII-Additional Metropolitan Magistrate, Bheemunipatnam, Visakhapatnam District. 2.

The petitioners are arraigned as accused Nos.1 to 4 in the aforesaid calendar case. They alleged to have committed the offence punishable under Section 498-A of I.P.C.

Heard Sri A.S.C. Bose, learned counsel for the petitioners. He confined his request to the extent of exempting appearance of the petitioners 2 to 4, who are parents-in-law and brother-in-law of the 2nd respondent/de facto complainant.

But, it is difficult to exempt appearance of the petitioners 2 & 3, who are the parents-in-law of the de facto complainant. To the extent of presence of 4th petitioner, who is brother-in-law of the de facto complainant and, incidentally, brother of the 1st accused /1st petitioner, is dispensed with. However, he shall appear before the Court when examination under Section 239 of Cr.P.C. takes place and also when the examination under Section 313 of Cr.P.C. takes place, and on other occasions as and when the learned Magistrate directs when his presence is absolutely necessary.

With the above observation, Criminal Petition is dismissed. As a sequel thereto, miscellaneous petitions if any pending in the criminal petition shall stand closed.
