HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.16427 of 2017 ORDER:

In this writ petition, the petitioner is aggrieved by the action of the respondents in not paying the Exgratia to her for the death of her husband - late Policharla China Pitchaiah due to the electric shock as per the Departmental Policy of the respondents - Southern Power Distribution Company of A.P. Limited (APSPDCL), issued vide S.O.O. (CGM-HRD) Rt.No.761, dated 26.10.2013, read with orders of the A.P. Electricity Regulatory Commission, Hyderabad, issued in proceedings No.APERC/Secy/EAS/S101/177/2013, dated 13.08.2013, even after a lapse of more than three years, as arbitrary and illegal.

Heard Sri P. Raghavendra Rao, learned counsel for the petitioner, as well as Ms. J. Koteswari Devi, learned Standing Counsel, appearing for the respondents - APSPDCL and perused the material on record.

According to the petitioner, her husband - late Policharla China Pitchaiah, s/o. Bala Nagaiah, met with a fatal electrical accident on 12.11.2014 and died instantly due to the said electric shock, while he tried to switch on the starter to run motor pumpset in the agricultural field at Agnigundala Village of Ipuru Mandal.

4. The material available on record discloses that for redressal of her grievance, though the petitioner has submitted a

AVSS,J W.P.No.16427 of 2017 representation, dated 04.04.2016, to the 1st respondent, no action has been taken till date.

Having heard learned counsel for the respective parties, without expressing any opinion on the merits of the case, this Court deems it appropriate to dispose of the writ petition directing the respondents to consider the representation, dated 04.04.2016, submitted by the petitioner and pass appropriate orders, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order. 6.

As a sequel, Miscellaneous Petitions pending consideration, if any, in the Writ Petition shall stand closed. No order as to costs.
