THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY I.T.T.A.NO.599 OF 2015 JUDGMENT: {Per the Hon'ble Sri Justice Ramesh Ranganathan} Sri J.V.Prasad, learned Senior Standing Counsel for Income Tax, would submit that, as the respondent-assessee merged with a company in Hyderabad, the matter was transferred from the Commissionerate at Delhi to the Commissionerate at Hyderabad for preferring an appeal; and, while the impugned order is an order passed by the Income Tax Appellate Tribunal, Delhi Bench, by oversight an appeal has been preferred before this Court. Learned Senior Standing Counsel, would submit that, as this Court lacks territorial jurisdiction to entertain this appeal, the petitioner be permitted to withdraw the appeal to enable them to approach the Delhi High Court.

Permission is accorded.

The ITTA is dismissed as withdrawn. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
