HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10948 OF 2016 ORDER:

The order under challenge is suspension pending enquiry dated 21.03.2016. The petitioner has been appointed as fair price shop dealer for Shop No.2319 of Ramannapet Village, Mallial Mandal, Karimnagar District. While so, based on the report submitted by the Deputy Tahsildar, (CS) Mallial, the 2nd respondent issued a show cause notice on 28.02.2016 levelling certain allegations that not distributing PDS Rice and sugar, to which the petitioner submitted his explanation on 08.03.2016. Dissatisfied with the same, the 2nd respondent by order dated 21.03.2016 suspended the authorization of the petitioner. Hence, the petitioner filed the present writ petition.

Considering the nature of allegations made with respect to variations with regard to the sugar and the contents of panchanama wherein though kerosene was distributed to the card holders, but no signatures were obtained. This matter is required to be enquired into.

In those circumstances, there shall be a direction to the respondents to complete the enquiry after considering the explanation submitted by the petitioner and pass final orders within a period of four weeks from the date of receipt of a copy of this order by duly observing the principles of natural justice and affording opportunity of being heard to the petitioner. With the above direction, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any pending in the writ petition, shall stand closed. ______________________________ CHALLA KODANDA RAM, J.
