Petitioners are aggrieved by the endorsement dated 31.08.2016 of the Tahsildar, Devipatnam Mandal, East Godavari District, rejecting their request for issuance of pattadar passbooks and title deeds on the ground that they are not in physical possession of the subject land.

Admittedly, against the decision of the Tahsildar, appeal shall lie under the provisions of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 before the Revenue Divisional Officer. However, so far no such appeal is preferred by the petitioners.

The petitioners seem to have submitted representation dated 31.10.2016 before the District Collector, Kakinada, East Godavari District. Therefore, the petitioners are granted liberty to prefer appeal subject to law of limitation. They are also granted liberty to file an application to treat the representation dated 31.10.2016 submitted by them as appeal and to consider the same in accordance with law.

The Writ Petition is accordingly disposed of leaving it open to the petitioners to file appeal or to make appropriate representation/request to treat the existing representation dated 31.10.2016 as appeal. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
