O R D E R

Heard Ms. B.Priyanka, learned counsel representing the learned counsel for the petitioner Mr. Bethi Venkateshwarlu and learned Assistant Government Pleader for Home for respondents.

The petitioner prays for mandamus, declaring the inaction of respondents in conducting fair, proper and legal investigation into Crime No.76/2012 dated 16.3.2012 of P.S.Kanchanbagh, Hyderabad, A.P., as illegal and unconstitutional.

Counsel vehemently contends that in spite of complaint disclosing commission of an offence, the respondent has not moved in the matter and hence the writ petition is filed.

The Assistant Government Pleader, on instructions, submits that the respondent has investigated the Crime No.76/2012 and the investigation reveals that no offence, muchless a cognisable office has been committed and final report stating that the dispute between petitioner and the accused in the complaint, is purely simple and civil dispute and, therefore the final report will be filed before the court concerned. Since the investigation is completed, final report is prepared, this court grants three weeks time from the date of receipt of a copy of this order, to respondent to serve a copy of final report on petitioner and to file before jurisdictional magistrate. Petitioner, if so advised, can pursue the remedies available in law.
