THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.46203 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondents in not transferring/ renewing the Tobacco barren licence T.B. No.24-011-009 in favour of the petitioner, as illegal and arbitrary. Heard and perused the material available on record. The petitioner is an agriculturist/ tobacco grower and he possessed agricultural land in Mamidipalem village of Prakasam District, in which there is a Tobacco barren bearing T.B. No.24-011-009. The father of the petitioner executed a Will dated 25.01.1990 in favour of the petitioner bequeathing the said barren and some properties and therefore, the petitioner is entitled to the transfer of the licence in respect of the above said Tobacco barren.
The grievance of the petitioner is that he made an application before the 3rd respondent requesting for renewal of the tobacco barren licence for the year 20162017 in his favour. Considering the circumstances of the case, without going into the merits, this Court is inclined to pass the following order: The respondents 2 and 3 are directed to consider the application submitted by the petitioner for transferring/ renewing of the Tobacco barren licnce T.B. No.24-011-009, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order. The petitioner is also directed to produce all the relevant documents to substantiate his claim for renewal of licence.
Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J January 04, 2017.
