O R D E R

The prayer of the petitioner in this case is as under: 'Hon'ble Court may be pleased to issue appropriate writ order, or direction more particularly one in the nature of writ of Mandamus declaring the Proceedings in file No.6/Skl/M/2012/Z-V dated 13-05-2014 issued by the 1st respondent is illegal, arbitrary and contrary to G.O.Ms. No.74 Rule 5 and pass such other Order or Orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

By the proceeding dated 13.05.2014, the Andhra Pradesh State Wakf Board constituted a Managing Committee for the Vadama Village Jamia Mosque, a notified wakf in Palakonda Mandal of Srikakulam District, for a period of two years commencing from 13.05.2014. No interim orders were granted by this Court interdicting the functioning of the Managing Committee constituted under the impugned proceeding. Sri N.Aswani Kumar, learned counsel for the petitioner, fairly stated that as the term of the Managing Committee constituted under the impugned proceeding has nearly concluded, adjudication as to the validity of the impugned proceeding is not warranted at this late stage.

Sri Syed Sohail, learned counsel for respondents 2 to 13, being the Managing Committee constituted under the impugned proceeding and its members, stated that the Managing Committee continued to function during this period and that its term is almost at an end. In that view of the matter, the writ petition is closed without going into the merits of the matter or the legality of the impugned proceeding dated 13.05.2014, which has almost worked itself out by efflux of time. The Andhra Pradesh State Wakf Board shall however be mindful of the legal requirements and shall constitute a new Managing Committee for the subject wakf institution in accordance with law. Pending miscellaneous petitions shall also stand closed.
