HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Writ Petition No.29041 of 2017 ORDER :

Heard the learned counsel for the petitioner/ accused in Cr.No.112 of 2017 dt.30.01.2017 of the Banjara Hills Police Station, Hyderabad, for the offences punishable u/ sec.420,417,405 and 406 of IPC and also heard the learned Govt. Pleader representing the respondents and perused the prayer in the petition with supporting affidavit and the written instructions received by the learned Govt. Pleader.

The prayer in the Writ Petition reads as follows:- " to issue a Writ or Order or Direction, particularly one in nature of Writ of Mandamus, questioning the inaction on the part of the respondents 1 and 2 in investigating the crime registered in FIR 112 of 2017 dated 30.01.2017 on the file of Banjara Hills Police Station, Banjara Hills, Hyderabad for the offences punishable u/ sec.420,417,405 and 406 IPC and under Section 156(3) CrPC and filing the final report (charge sheet) under Section 173 of CrPC, as arbitrary, illegal, unfair, unjust and violation of Article 14 of Constitution of India, and consequently to direct the 2nd respondent to complete the investigation and file the final report immediately in the interest of Justice, pending disposal of the Writ Petition, in the interest of Justice and pass such order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

As per the written instructions of the learned Govt. Pleader within the two months the investigation could be completed by them and file report u/ sec.173 CrPC, and a notice u/ sec.91/ 160CrPC, was already issued to the accused to produce relevant witnesses as part of investigation which is in progress since registration of the crime dated 30.01.2017.

Having regard to the above and in the result, the Writ Petition is disposed of directing the police to complete the investigation within two months from the date of receipt of the order and file final report by intimation of the progress to the defacto-complainant/ Writ Petitioner.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
