THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7658 of 2016 ORDER:

This writ petition is filed questioning the appointment of 6th respondent as a temporary dealer in place of the existing Fair Price Shop Dealer on account of the pending enquiry against the existing Fair Price Shop Dealer, whose license has been suspended. Heard the learned counsel for the petitioner as well as the learned Government Pleader for Civil Supplies. Perused the records. Inasmuch as, the petitioner does not have any right to be appointed as a Fair Price Shop Dealer and that to in the given case the contingencies arising on account of suspension of regular fair price shop dealer's licence, the writ petition itself is misconceived.

Though the learned counsel for the petitioner submits that she had filed a representation before the authorities and the same may be directed to be considered, I am afraid such relief of directing the authorities to consider the petitioner's representation without there being a right in favour of the petitioner is misconceived and as per the judgment held by the Supreme Court in Mani Subrat Jain v. State of Haryana[1]. such orders cannot be issued.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
