THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.23468 of 2007 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The seizure of a car belonging to the petitioner, by proceedings dated 26.10.2007, is questioned in this writ petition as being arbitrary and illegal. The reason why the vehicle was seized is that it was plying in A.P, without life tax being paid, and without a pollution certificate having been obtained for the vehicle. By way of an interim order dated 06.11.2007, this Court directed release of the vehicle subject to an undertaking by the petitioner that he shall produce the vehicle as and when required, and that he shall not alienate the vehicle. Nearly nine years have since elapsed.
The case of the petitioner is that the vehicle was registered at Nanded in the State of Maharashtra; life tax was paid at the time of registration; he was carrying on cloth business in Palaz Village, Bhoker Taluq, Nanded District of Maharashtra; he came to visit his brother, who is a Sarpanch at Kuber Village and Mandal of Adilabad District, which is five kilo meters from his native village of Palaz; and, merely because the vehicle entered the erstwhile State of Andhra Pradesh, it was directed to be seized.
Since no action has been taken against the petitioner for the past nine years, and as the vehicle was directed to be released pursuant to the interim order passed by this Court, no further orders are necessary in this writ petition.
The Writ Petition is, accordingly, closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
