THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Criminal Petition No.7252 of 2015 ORDER:

Accused no.3 in C.C.No.261 of 2015 on the file of the Court of the Judicial Magistrate of First Class, Kodad had filed this criminal petition under Section 482 of the Code of Criminal Procedure requesting to quash the proceedings against her in the above said Calendar Case.

2. Heard the learned counsel for the petitioner/A3 and the learned Additional Public Prosecutor representing the 1st respondent/State. Perused the material record.

The case of the petitioner is this: - 'She is working as a SubEngineer in Office of Divisional Engineer (Electrical), Miryalguda. She is the sister of the first accused. Since a long time she is staying away from her parents' house. She is innocent and has been un-necessarily roped in though she is not involved in any offence, on the allegation that she abetted her brother-A1 to demand dowry from the de facto complainant.'

4. During the course of hearing, it is submitted by the learned counsel for the petitioner that the criminal petition may be disposed of by an appropriate order dispensing with the presence of the petitioner/A3 before the trial court except on the dates when her presence is necessary.

Having regard to the facts and the submissions, this court is satisfied that the presence of the petitioner/A3 can be dispensed with.

6. In the result, the Criminal Petition is disposed of dispensing with the personal appearance of the petitioner/A3 in CC.No.261 of 2015 on the

file of the Court of the Judicial Magistrate of First Class, Kodad. However, she shall appear before the trial Court as and when directed by the trial Court.

Miscellaneous petitions pending, if any, in this petition shall stand closed.
