SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2554 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.1, in Crime No.115 of 2017 on the file of the Station House Officer, Nandyal II Town Police Station, Kurnool District. The offence alleged is under Section 307 R/w.34 of I.P.C. 2.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

The case of the prosecution is that the petitioner along with accused No.2 attacked the de-facto complainant and abused him in filthy language. 4.

Learned counsel for the petitioner fairly submits that the earlier bail petition filed by the petitioner was dismissed by this Court, by virtue of the orders in Criminal petition No.1018 of 2018, on 07.02.2018. 5.

Hence, in the light of the said order, this Criminal Petition is not maintainable. However, the petitioner/accused No.1 is at liberty to surrender the before the lower Court having jurisdiction and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, on merits, preferably on the same day, subject to pressure of other work.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
