THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9493 of 2017 ORDER:

Aggrieved by the inaction on the part of the 3rd respondent-Assistant Director of Mines and Geology, in not issuing dispatch permits for transportation of mineral quartz and feldspar in pursuant to the lease granted and work orders issued by the 3rd respondent, vide proceedings dated 31.12.1999, for conducting quarry operations in over an extent of 2-47 acres, situated in Sy.No.76 of Pothapalli Village, Veldanda Mandal of Mahabubnagar District, the present writ petition is filed.

Heard the learned counsel for the petitioner and the learned Government Pleader for Mines and Geology (Telangana).

The grievance of the petitioner is that though the lease granted in his favour is valid till 30.12.2019, the 3rd respondent has not been issuing any dispatch permits for lifting the material, which was mined, therefore, he made representations on 20.02.2017 and 14.03.2017 to the 2nd respondent-Director of Mines & Geology, Hyderabad, however, no action has been taken by the 2nd respondent.

Having regard to the facts and circumstances of the case and in view of the pendency of the representation dated 14.03.2017, before the 2nd respondent, the Writ Petition can be disposed of by directing the 2nd respondent to consider and dispose of the said representation within a period of four weeks from the date of receipt of a copy of this Order. Ordered accordingly. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the Miscellaneous Petitions, if any pending, shall stand closed.
