THE HON'BLE SRI JUSTICE RAJA ELANGO Transfer Criminal Petition No.71 of 2016 ORDER:

This Transfer Criminal Petition is filed under Section 407 Cr.P.C. seeking to transfer S.C.No.81 of 2015 pending on the file of District and Sessions Judge, Nizamabad to the Court of Metropolitan Sessions Judge, Vijayawada, Krishna District where similar cases were transferred and pending.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The main case of the petitioner is that by virtue of order dated 06-02-2014 in W.P.No.31381 of 2013, various similar cases were transferred to Metropolitan Sessions Judge, Vijayawada, Krishna District and the same are pending consideration. The present case is also similar to that of the cases, which has to be tried and decided along with those cases, as the entire property of the company was attached and produced before Metropolitan Sessions Judge, Vijayawada and that the same is liable to be transferred to those cases.

Having regard to the facts and circumstances of the case and on perusal of the material on record, this Court is of the view that in order to meet the ends of justice, the S.C.No.81 of 2015 is liable to be transferred from the Court of District and Sessions Judge, Nizamabad to the Court of Metropolitan Sessions Judge, Vijayawada, Krishna District, where similar cases are pending, for trial and disposal of the same along with those cases. Accordingly, the Transfer Criminal Petition is allowed and

the case in S.C.No.81 of 2015 pending on the file of District and Sessions Court, Nizamabad is withdrawn from that Court and transferred to the Court of Metropolitan Sessions Judge, Vijayawada, Krishna District, for trial and disposal along with similar cases pending before it.
