THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.17679 of 2017 ORDER:

Heard the learned counsel for petitioner and Sri J.Srinivasa Rao, learned Standing Counsel for respondents. 2.

Petitioner was employed as General Mazdoor in Singareni Collieries Company Limited. Since he suffered paralytic stroke in 2010, after referring him to Kothagudem Main Hospital, he was recommended unfit for underground job in a mine and later recommended for surface General Mazdoor job and he was posted to work in Civil Department in Singareni Collieries Company in December, 2010.

Petitioner, however, gave a representation on 15-07-2013 and also on 20-06-2014, 12-04-2016 and 11-03-2017 stating that he is unable to work in the Civil Department also because of pain in leg and hand and would like to have a Corporate Medical Board to medically examine him.

This request of the petitioner has not been acceded to by the Singareni Collieries Company Limited till date and no reason has been assigned why it has not taken any action on this representation.

Therefore respondents are directed to constitute a Medical Board for conducting of medical examination of petitioner within six (06) weeks from the date of receipt of a copy of this order and

MSR,J W.P.No.17679 of 2017 get the petitioner examined to decide about his fitness to discharge the job in the Civil Department of the Singareni Collieries Company Limited.

The Writ Petition is disposed of with the above directions. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
