THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21255 of 2016 ORDER:
Against the order dated 19.05.2016 passed by the 3rd respondent Revenue Divisional Officer, Rajampet Division, the petitioner has already preferred an Appeal before the 2nd respondent Joint Collector, Kadapa on 28.05.2016 along with an Application for stay, but so far, no orders have been passed thereon is the grievance made out by her in this Writ Petition.
The petitioner is the fair price shop dealer of Shop No.37 of Hasthavaram Cherlopalli Village, Rajampet Mandal, Kadapa District. On the ground that there is variation in the stock available with the petitioner, on physical verification, her authorization was cancelled by the 3rd respondent.
Learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies (Andhra Pradesh) would fairly submit that a direction to the 2nd respondent Joint Collector to dispose of the Appeal preferred by the petitioner, within a fixed time-frame, would meet the ends of justice.
In view of the abovesaid submission, without going into the merits of the matter, the Writ Petition is disposed of directing the 2nd respondent Joint Collector to consider and pass appropriate final orders on the Appeal so preferred by the petitioner on 28.05.2016, after observing the principles of natural justice, within four weeks from the date of receipt of a copy of this order.
Pending consideration of the Appeal, the petitioner shall be permitted to function as the fair price shop dealer of the subject shop. No costs.
Consequently, the Miscellaneous Applications, if any shall also
stand disposed of.
