THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.28199 of 2016 ORDER:

The petitioner has assailed the proceedings dt.10-08-2016 of the 2nd respondent refusing renewal of petitioner's Arms licence 2.

Petitioner contends that he is from Nagaland State and had Arms licence upto 30-12-2015 and he was employed as a Security Guard and if his Arms licence is not renewed, it will effect his employment. 3.

The impugned order passed by 2nd respondent states that there is no threat perception insofar as petitioner is concerned, and his Arms licence cannot be renewed for job purpose.

No opportunity to the petitioner to put forth his case was given by 2nd respondent. If the stand taken by 2nd respondent is accepted, then financial establishments such as Banks and business houses cannot protect themselves by engaging Security Guards. 5.

Therefore, the impugned order is set aside and the matter is remitted back to the 2nd respondent to give an opportunity to give personal hearing to petitioner and to pass a reasoned order considering the situation of the petitioner. This exercise shall be done within four

(04) weeks from the date of receipt of a copy of this order. 6.

The Writ Petition is disposed of with the above directions. No costs.

MSR,J W.P.No.28199 of 2016 7.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
