THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9490 OF 2015 ORDER:

This criminal petition is filed by the petitioner seeking to relax the condition No.(ii) i.e., "the petitioner/accused officer No.5 shall stay in his constituency i.e., Sattupally constituency and he shall not leave his constituency until further orders" imposed in the order dated 14.07.2015 passed in Crl.M.P.No.544 of 2015 by the learned Principal Judge for SPE and ACB cases cum IV Additional Chief Judge, City Criminal Courts, Hyderabad. Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is a M.L.A., from Sattupalli Constituency, Khammam District, and he has to interact with the District Administration and the Revenue officials regarding the grievances of the people and has to supervise the developmental works in the constituency and as such, seeks to relax the condition mentioned above. Considering the facts and circumstances of the case, the condition that he shall not leave the Sattupally Constituency until further orders is hereby relaxed, by imposing a condition that he shall not enter Hyderabad except to attend the Assembly Sessions, when the Assembly is in session. Further, the petitioner is directed to appear before the respondent as and when required. The Criminal Petition is accordingly disposed of. _____________________ JUSTICE RAJA ELANGO 21.09.2015 pln
