THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.8238 of 2019 ORDER:

This writ petition is filed challenging the action of respondent Nos.2 to 4 in not interrogating and not arresting the unofficial respondents, basing on the complaint, dated 18.04.2017, made by the petitioner vide Crime No.311 of 2017 of Medipally Police Station, Rachakonda Commissionerate.

Heard learned counsel for the petitioner and learned Government Pleader for Home.

Learned Government Pleader for Home produced written instructions stating that the crime was investigated into and found that there is no evidence supporting the allegation of the petitioner. As such, the Investigating Officer addressed a letter to the Commissioner of Police, Rachakonda, on 25.06.2018, to accord permission to refer the case as 'false'. He further submits that the Commissioner of Police, vide proceedings, dated 22.05.2019, directed to conduct further investigation and the same was investigating into. He further submits that during the course of investigation, on 26.05.2019, the Investigating Officer examined one Rajapeta Jaganmohini D/o.Vasantha Chary, and recorded her statement, wherein she stated that Bujjinder Reddy did not abuse the complainant and beat her. As there are no independent witnesses in this case to support the case, a letter was addressed to the Commissioner of Police, Rachakonda, on

20.06.2019, to refer the case as 'false'. He further submits that after obtaining orders from the Commissioner of Police, Rachakonda, a final report will be filed before the concerned Court. 4.

Recording the said submission, the writ petition is disposed of. However, it is open for the petitioner to challenge the said report before the concerned Court, in accordance with law. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
