THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD CMA NO. 4213 OF 2004 JUDGMENT:

This appeal is directed by the claimant against the order dated 06.05.2004 passed by the Motor Accidents Claims Tribunalcum- District Judge, Warangal (for short 'the Tribunal), in M.V.O.P.No.607 of 2002, whereby the Tribunal dismissed on the ground that the claimant is not entitled for compensation as he was gratuitous passenger.

A perusal of the material available on record, the claimant received three simple injuries, which are minor abrasions and he was treated as outpatient. Having regard to the facts and circumstances of the case, the injuries are simple in nature, the injured treated as outpatient, the claimant is unauthorized passenger in a goods vehicle on the date of accident and not carrying on any goods along with him. Therefore, the order passed by the tribunal is well considered and needs no interference by this Court.

Accordingly, MACMA is dismissed. There shall be no order as to costs.
