This writ petition is filed challenging the order of the Assistant Commissioner of Labour and Authority under the Minimum Wages Act in MWMP No.1 of 2007 filed by Md. Arif Pasha, the 2nd respondent herein. By order dated 16.03.2007, the said petition was allowed partially and the claim for the period from 01.09.2005 to 30.11.2006, numbered as M.W.105 of 2007, was posted for hearing.

As notice was not served on the 2nd respondent, by order dated 23.06.2011, learned counsel for the petitioner was permitted to take out personal notice to the 2nd respondent by registered post with acknowledgment due and file proof of service within a period of two weeks. The Court also ordered that in default, the writ petition should stand dismissed against the 2nd respondent without further reference to the Court. As no proof of service was filed within the time granted, the writ petition was dismissed against the 2nd respondent.

Since the writ petition was already dismissed against the 2nd respondent, the cause in the writ petition does not survive for adjudication and the same has become infructuous. 4.

The writ petition is accordingly dismissed. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
