O R D E R
Assailing the seizure of the petitioner's vehicle bearing No. TS 12 UA - 1367 under check report No.TS817/APRIL 2019/1928 dated 01.04.2019 of the 3rd respondent, the present writ petition is filed. When the matter is taken up for hearing, learned counsel for the petitioner as well as the learned Government Pleader for Transport, would submit that the issue raised in this writ petition is squarely covered by the order of this court in W.P.No.5841 of 2019 dated 20.03.2019.
This court, in W.P.No.5841 of 2019 dated 20.03.2019, while considering the seizure of the vehicle of the petitioner therein, for violation of permit conditions, disposed of the writ petition with the following directions: "For the foregoing reasons, the writ petition is disposed of, directing that: (a) the vehicle of the petitioner bearing registration No. TS 09 UB-1234 shall be released to it on depositing a sum of Rs.10,000/- (Rupees ten thousand only);
(b) the petitioner shall also furnish an undertaking to the effect that it will not alienate the vehicle till the proceedings in pursuance of the check report are finalized and that it will produce the vehicle as and when required;
(c) the petitioner shall be entitled to ply the vehicle, if only it is covered by the necessary documents; and (d) the petitioner shall not be entitled to use the vehicle unless it is registered.
The present writ petition is also disposed of mutatis mutandis, in terms of the above directions of this court in W.P.No.5841 of 2019 dated 20.03.2019. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
