Petitioner claims that she was the absolute owner and in possession of the land to an extent of Ac.1-94 cents in D.No.570/80C of Pedaparmi Village. Initially it was leased out to her brother's son. Later by misleadiong her, her brother and brother's son-in-law, took her to the Registrar Office and obtained signatures from her, which later turned into registration of deed of conveyance of the subject property and under the guise of illegally obtaining of deed of conveyance, the names of those persons were mutated in the revenue records. Petitioner alleges that such mutation was illegal.

The facts briefly noted above, clearly disclose that the registered deed of conveyance was executed by the petitioner in favour of the persons named in the affidavit filed in support of the writ petition. If such deed of conveyance was obtained by fraudulent means as sought to be contended, the remedy lies elsewhere. Therefore, prima-facie, it cannot be said that mutation was illegally done in order to grant relief as prayed for by the petitioner.

Thus, leaving it open to the petitioner to work out her remedies as available in law, on the allegation of obtaining illegal deed of conveyance, the Writ Petition is dismissed. There shall be no order as to costs.
