THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.3547 of 2017 ORDER:

Heard learned counsel for the petitioner as well as the respondent.

As can be seen from the order under challenge, the lower appellate Court considering the fact that the defendant filed CMA.No.1 of 2017 against the order, dated 24.04.2017, passed by the trial Court in I.A.No.393 of 2017 in O.S.No.240 of 2017, granting ex parte ad interim injunction in favour of the plaintiff, allowed the said CMA vide its order, dated 16.05.2017, by setting aside the order of ex parte ad interim injunction, dated 24.04.2017, with the direction to the trial Court to dispose of I.A.No.393 of 2017 on merits within one month from the date of filing counter by the defendant.

Having regard to the facts and circumstances of the case and considering the request of both the learned counsel to dispose of the present Civil Revision Petition, without going into the merits of the case, this Civil Revision Petition is disposed of with the direction to the trial Court to pass appropriate orders on merits in I.A.No.393 of 2017 in O.S.No.248 of 2017

CKR, J CRP.No.3547 of 2017 expeditiously, at any rate, within four weeks from the date of receipt of a copy of this order.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
