THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8323 of 2019 O R D E R:
The petitioner seeks the relief in the nature of mandamus to the respondents to allot one shop, particularly shop No. 233 or 292 out of 51, which are vacant, by the Vegetable Market Yard Committee, Gudimalkapur, Mehdipatnam, Hyderabad. The petitioner submits that as per the information obtained from the Agricultural market Committee, on 05.03.2018, under the Right to Information Act, 51 shops are vacant and that he had made an Application on 18.02.2019 seeking allotment of one such shop.
During pre-lunch session, the matter was passed over so as to enable the learned Standing Counsel Smt. Neerja Reddy for the Agricultural Market Committee, secure instructions. In the Afternoon, learned Standing Counsel submits that all the shops have already been allotted and there are no vacant shops right now. However, in the event of any possibility, the Application of the petitioner will be considered.
In view of the said submission, the Writ Petition is disposed of giving liberty to the 4th respondent to take a decision on the Application of the petitioner, subject to availability of the vacant shops, in accordance with the procedure prescribed therefor. The Writ Petition is disposed of with this order. No costs. Consequently, the miscellaneous Applications, if any stand closed.
