THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.25731 OF 2005 ORDER:

This writ petition is filed seeking to declare the action of the respondents in not granting patta to the petitioners in respect of land in R.S.No.331 in an extant of Ac.8.50 cents of Royyuru village, Thotlavalluru Mandal, Krishna District even though the petitioners are cultivating the land since 70 years as arbitrary, bad and illegal and violative of Article 14 of the Constitution of India and consequently set aside the impugned proceedings of the respondents.

Since 1936 petitioners are in possession and doing cultivation of Lanka lands (dibba) which are subject matter of Estate Abolition Act and in view of changed circumstances, there is a threat of dispossession. Since the petitioners are in possession of the subject lands, they are entitled for pattas as per law.

In view of the above circumstances, the writ petition is disposed of directing the respondents to consider the request of the petitioners for grant of pattas as per law. Till the decision is taken, the petitioners shall not be dispossessed from the subject lands without following due process of law. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
