THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.NOS.8180, 8181, 8188, 8204 AND 8246 OF 2019 COMMON ORDER Aggrieved by the proceedings of the Telangana State Election Commission, in disqualifying the petitioners in all these writ petitions under Section 19-B of Telangana Panchayat Raj Act, 1994 (for short 'the Act') and Rule 103(8) of Telangana Panchayat Raj (Conduct of Election) Rules, 2006 (for short 'the Rules') for failure to lodge final accounts of election expenses, the present writ petitions have been filed.
Learned counsel appearing for both the sides would submit that the issue involved in the present writ petitions is squarely covered by the common order in W.P.No.2630 of 2018 and batch dated 20-03-2019, wherein the learned single Judge of this court, set aside the orders of disqualification visited upon the petitioners therein by the Commission.
In view of the same and for the reasons alike, the present writ petitions are allowed and the respective impugned proceedings, disqualifying the petitioners, under Section 19-B of the Act and Rule 103(8) of the Rules, are set aside. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
