HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.34134 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus, declaring the inaction of the 5th respondent to take up investigation and arresting the accused in Crime No.482 of 2014 dated 01.10.2014 offence under Section 448, 354 of IPC which are illegal, highhanded, arbitrary, unconstitutional and against the principles of natural justice and consequently direct the 5th respondent to arrest the accused in Crime No.482 of 2014 dated 01.10.2014, offence under Section 448, 354 of IPC."

The 5th respondent filed a counter affidavit, wherein it is stated that pursuant to the complaint lodged by the petitioner on 01.10.2014, a case in Crime No.482 of 2014 for the offence under Sections 448 and 354 IPC was registered on the file of Narayanaguda Police Station, Hyderabad, and investigation was taken up. However, by the date of filing of the counter affidavit, investigation was not completed.

Now, learned Government Pleader brought to the notice of this Court that investigation in Crime No.482 of 2014 was completed and a charge sheet was filed before the IX Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. After taking cognizance of the offence, the same was taken on file as C.C.No.696 of 2014, which is pending trial.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition.

Accordingly, the writ petition is closed. No order as to costs.
