THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 37667 of 2014 ORDER:
The petitioner claims ownership over the land admeasuring Ac.0-20 gts in Survey No.231/A/1 and Ac.0-20 gts in Survey No.231/AA/2, having purchased the same from respondents 6 and 7, through registered document Nos.4793 and 4788 dated 16.10.2002, and his name was mutated in the revenue records. It is averred in the writ affidavit that due to property disputes between the family members of the vendors of the petitioner, the vendors of the petitioner filed suits against their brothers in concerned Civil Courts and a Second Appeal is also pending before this Court in S.A.No.381 of 2010, wherein this Court ordered maintenance of status quo by order dated 28.09.2010.
It is stated that though the property purchased by the petitioner is the subject matter of the suits filed before the concerned Courts, the petitioner was not made a party to the proceedings before the Courts. It is further stated that the respondents 5 to 7 herein have filed a Revision Petition before the 2nd respondent-Joint Collector seeking cancellation of pattadar passbooks issued in favour of the petitioner. The petitioner, by way of this writ petition, prays to direct the 2nd respondent to issue notice to him before passing any orders in the Revision Petition filed by the respondents.
2. Heard learned counsel for the petitioner as well as the respondents.
3. At the hearing, learned counsel for the petitioner submits that the petitioner has filed a detailed representation and objections to the respondent-authorities. The counsel further submits that a direction to the 2nd respondent to consider the representation and objections made by the petitioner in the Revision Petition filed by the unofficial respondents before the 2nd respondent would suffice.
4. In view of the submissions made, I deem it appropriate to direct the
2nd respondent to consider the representation and objections said to have been filed by the petitioner and, if the petitioner desires, afford an opportunity of personal hearing before passing orders in the Revision Petition.
5. With the above direction, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
