THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 18299 of 2016 ORDER:

The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the third respondent seeking dispossession of the petitioner from the land admeasuring Acs.2.50 cents in Survey No.237/1F in Gangavaram Village, Gangavaram (Agency) Mandal, East Godavari District, without following due process of law.

Though various grounds are raised, learned counsel for the petitioner submits that the petitioner is landless poor person and was granted D-Form patta on 20.10.2001, in respect of the land referred to above. Since the grant of D-Form patta, the petitioner has been cultivating the land. It is urged that without following due process of law and without giving any notice, the third respondent is trying to dispossess the petitioner from the said land. Learned Government Pleader opposed the above submission. However, he submits that any dispossession made shall be in accordance with law.

Having regard to the circumstances stated above and without going into merits of the case, the writ petition is disposed of directing the third respondent to follow due process of law, before taking any steps of dispossession of the petitioner from the land in Survey No. Acs.2.50 cents in Survey No.237/1F in Gangavaram Village, Gangavaram (Agency) Mandal, East Godavari District. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _______________________ JUSTICE C. PRAVEEN KUMAR
