THE HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.4351 OF 2015 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed to quash the proceedings in C.C.No.95 of 2015 on the file of learned XIII Additional Chief Metropolitan Magistrate, Hyderabad.

Heard both sides.

Petitioners herein are the parents-in-law and A1 is the husband of respondent No.1. The allegation against the petitioners is that they along with A1 harassed respondent No.1 physically and mentally so as to get rid of her and to perform second marriage to A1.

After arguing for some time, learned counsel for the petitioners while not pressing the main prayer, requested this Court to dispense with the presence of the petitioners in the trial Court.

Considering the facts and circumstances of the case, the trial Court shall proceed with the trial of the case. However, the presence of petitioners/A2 and A3 during the course of trial before the trial Court is hereby dispensed with, except on the date or dates on which the learned trial judge insists their presence.

With the above observation, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
