HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 4471 OF 2016 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties the present Writ Petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the third respondent - Joint Collector in not disposing of the appeal bearing Roc.No.F5/SR.No.112/11(a)/1980, pending before the Joint Collector, as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioners submits that since 1980, the said appeal is pending before the Joint Collector. In view of the same, it is urged that in view of the pendency since last 35 years, the petitioners who are aged about 76 and 69 years are put to lot of inconvenience. Learned Government Pleader for Revenue submits that if the appeal is still pending consideration, the same may be directed to be disposed of at the earliest.

Without going into merits of the case and having regard to the submissions made, the Writ Petition is disposed of directing the Joint Collector-cum-Settlement Officer, Chittoor, to dispose of appeal bearing Roc.No.F5/SR.No.112/11(a)/1980, if it is still pending consideration, at the earliest, preferably within a period of three (03) months from the date of receipt of a copy of this order. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
