HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.11506 of 2007 ORDER:

This writ petition is filed questioning the notification dated 08.05.2007 issued under Section 4(1) of the Land Acquisition Act (for short 'the Act') proposing to acquire the lands of the petitioners in an extent of Ac.6.19 cents in Sy.No.68/ 2A situated at Mallisala Village, Jaggampet Mandal, East Godavari District.

2. This writ petition was admitted by this court on 07.06.2007 and an interim stay was also granted on the same day. The said interim stay was made absolute on 20.09.2010.

3. Today, when the matter came up for hearing, learned Assistant Government Pleader for Land Acquisition placed the written instructions dated 01.12.2017 of the Revenue Divisional Officer, Peddapuram, before this court, wherein it is stated that the lands covered by the present petition are in possession of the petitioners and no compensation was paid. It is also stated that they are not proceeding further to acquire the land of the petitioners and that if the land is still requires, they will initiate fresh land acquisition proceedings. The written instructions are placed on record.

4. In view of the written instructions of the Revenue Divisional Officer, Peddapuram, no further orders are required to be passed in this writ petition and the writ petition is liable to be closed.

5. Accordingly, the writ petition is closed. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition, shall stand closed.
