HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.8322 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ..... to issue a writ or order, orders or directions more particularly one in the nature of Writ of Mandamus declaring action of the Respondent No.3 who has not consider the Memo vide Memo No.12257/ RD/ A1/ 2016-2, dt.06.04.2017 issued by Respondent No.2 to consider the petitioner's representation for promotion as Project Manager (L5 Cadre) even though he is eligible to the said post ......" Heard Mr.M.Prudhvi Raj, learned counsel for petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that he is fully eligible and qualified to be promoted to the post of Project Manager, but the respondents are not considering his case for promotion. Therefore, the petitioner has submitted a representation on 23.03.

2017 and the 2nd respondent had issued Memo on 06.04.2017 directing the 3rd respondent to consider the case of the petitioner for promotion to the post of Project Manager on par with his juniors. Though the 2nd respondent has issued Memo on 06.04.2017, the 3rd respondent has not passed any orders so far.

Learned counsel for the petitioner has contended that appropriate orders be passed in the writ petition directing the 3rd respondent to consider the case of the petitioner in terms of Memo, dated 06.04.2017, issued by the 2nd respondent within a reasonable period of time.

Learned Government Pleader appearing for the respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed by the 3rd respondent strictly in terms of Memo, dated 06.04.2017.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the 3rd respondent to consider the case of the petitioner in terms of Memo, dated 06.04.2017, issued by the 2nd respondent and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
