THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.26023 of 2015 ORDER:

The petitioner was appointed as Fair Price Shop Dealer in respect of Shop No.108, Dharmavaram, Anantapur District. A show cause notice, dated 17.07.2015, was issued to the petitioner. The petitioner submitted her explanation on 24.07.2015. When an order of suspension, dated 01.08.2015, was passed by the 3rd respondent, the present Writ Petition is filed. This Court carefully perused the impugned order of suspension, which contains the allegation made against the petitioner with regard to running of the Fair Price Shop through a benami, by name, A. Prasad, whom the petitioner claims to be her husband. The impugned order also shows that the name of the said benami person was not included in the ration card and the petitioner was misguiding the authorities. However, the matter has to be enquired into by the competent authority.

In the circumstances, this Court is not inclined to suspend the order passed by the 3rd respondent. However, the 3rd respondent shall complete the enquiry in respect of the allegations made against the petitioner and after giving due opportunity of hearing to her, pass appropriate orders within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

The miscellaneous petitions pending, if any, shall stand closed.
