THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.13499 of 2016 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Revenue appearing for respondents.

2. The grievance of the petitioner in this Writ Petition is that the petitioner had presented a document for registration before the 5th respondent, but the 5th respondent has refused to receive and register the document basing on a letter addressed by 3rd respondent to him.

3. The issue raised herein was also considered by this Court in W.P.No.3236 of 2014 decided on 06-02-2014 and also W.P.No.12516 of 2012 decided on 21-06-2012.

4. Therefore for the reasons alike, this Writ Petition is also allowed and the action of the Sub-Registrar, Renigunta, Chittoor District in refusing to receive, register and release the documents relating to the subject land basing on the letter dt.03-03-2015 addressed by 3rd respondent to the said Sub-Registrar is set aside and a direction is given to the said Sub-Registrar to process

the document presented by petitioner for the purpose of registration without insisting for production of pattadar pass book or title deed taking into account the letter dt.3005-2012 and the endorsement dt.17-01-2014. It is also open to the said Sub-Registrar to verify as to whether the document presented by the petitioner is in accordance with the provisions of the Indian Stamp Act, 1899 and the Registration Act, 1908. No costs.

5. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
