HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35049 of 2016 ORDER:
1) Heard learned counsel for the petitioner, Government Pleader for Revenue, Government Pleader for Finance and Planning and Government Pleader for Social Welfare. With the consent of all the parties, the writ petition is heard at the admission stage itself.
2) The present writ petition came to be filed challenging the notice vide Rc B/ 6/ 2011, dated 16.09.2016 issued by the Tahsildar, Vijayawada Urban, on the ground that the Tahsildar has no jurisdiction to issue the said notice.
3) A perusal of the material on record would show that the petitioner herein submitted an explanation to the notice on 10.10.2016. It is stated that without passing any orders on the explanation, the respondent authorities are trying to take steps for recovery of the amount.
4) Having regard to the above, the Tahsildar-2nd respondent is directed to pass appropriate orders on the explanation submitted by the petitioner, within a period of three weeks from the date of receipt of a copy of the order. Till such time, the respondents shall not take any steps for recovery of the amount. 5) With the above direction the writ petition is disposed of. No order as to costs.
6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
