ORAL ORDER:

Petitioner applied for building permission on 10.7.2013 which was returned on 19.7.2013 to submit relevant documents in proof of ownership. Earlier challenging the said endorsement, petitioner filed W P No. 32327 of 2014 but same was withdrawn later. Petitioner claims that in compliance of the objections, he has submitted representation enclosing all the relevant documents but still no decision was taken. Having regard to these facts, writ petition was disposed of directing the second respondent to consider the representation of petitioner dated 30.4.2015 and if the petitioner complied with the objections raised vide endorsement dated 19.7.2013, to process the building permission application of the petitioner. Liberty was also granted to respondent corporation to take appropriate decision if they are not satisfied with the compliance reported by the petitioner. On due consideration of the directions of this Court, endorsement dated 1.5.2017 was issued rejecting the request of the petitioner for grant of permission.

The direction was only to consider the representation of the petitioner and such consideration was made and an order was passed. No case is made out for initiating proceedings under Contempt of Courts Act, 1971. Contempt case is closed granting liberty to the petitioner to workout his remedies, if so advised, against the decision communicated vide endorsement dated 1.5.2017. No costs.
