HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 23825 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner is the owner of rice mill. While so on 6.6.2015 the third respondent visited the godown and seized stock worth Rs.5,53,350/- alleging that it was PDS rice. The third respondent filed a report before the second respondent, based on that, the second respondent issued a notice under Section 6A of the Essential Commodities Act. The petitioner seeks release of the seized PDS rice. Hence the Writ Petition. Trite to state, continued detention and seizure of the vehicle and goods does not advance any purpose or interest of the respondents. The interest of the respondents can be protected by directing that the seized goods of the petitioner be released subject to certain conditions.

In the circumstances, the second respondent is directed to release the seized PDS rice on condition of the petitioner furnishing bank guarantee for a sum of Rs.5,53,350/- within a period of fifteen days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
