This petition is filed for a writ of mandamus declaring the action of the respondents in not allowing the petitioners to discharge their duties up to attain the age of 60 years as far with the 3rd respondent company employees as illegal and arbitrary and consequently direct the 3rd respondent to take back the petitioners into their services by allowing them to discharge their duties for a period of two years from the date of their reinstatement as per the existing guidelines of the 3rd respondent company. Learned counsel for the petitioners submits that earlier, petitioners filed, WP.Nos.38433/2014 and 22729/2013 seeking direction to the respondents to allow them to discharge their duties till they attain the age of 60 years and this Court basing on the common order dated 30.06.2008 passed by this Court in WP.Nos.

13272, 13839, 15478 of 2008, which was also confirmed in WA.No.775/2008 dated 30.07.2008, disposed of the said writ petitions on 24.04.2017, without granting any relief. Now learned counsel for petitioners submits that in view of the cabinet approval dated 21.02.2013, petitioners filed present writ petition.

It is to be seen that even as per petitioners the Cabinet Approval took place on 21.02.2013 i.e. before passing the orders in

the earlier writ petitions, and same was also brought to the notice of this court in the said writ petitions but no relief was granted. Therefore, the petitioners cannot file the present writ petition with same prayer.

In view of the same, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
