It is the case of the petitioners that they are the owners and possessors of the land in Survey No.267 in an extent of Ac.1.39 guntas situated at Allapur Village of Toopran Mandal, Medak district, by virtue of simple sale deed dated 23.3.1995. The names of the petitioners are recorded in the revenue records and pattadar passbooks were also issued to them. In the year 2007, the unofficial respondents 6 to 8 filed O.S.No.85 of 2007 against the petitioners on the file of the Senior Civil Judge at Siddipet, Medak district for declaration of title and for recovery of possession in respect of the subject land. The Trial Court decreed the suit on 20.9.2010. Aggrieved by the same, the petitioners preferred appeal before the VI Additional District Judge at Siddipet. When the 4th respondent, Tahsildar, issued Notice dated 28.8.

2017 to the petitioners on an application filed by the respondents 6 to 8 for mutation of their names, the petitioners filed objections on 1.9.2017 and got issued Legal Notice dated 2.9.2017 objecting for mutation.

Petition No.30975 of 2017. The 4th respondent passed order dated 3.1.2018 allowing the application filed by the unofficial respondents for mutation of their names. Aggrieved by the said order, the petitioners preferred appeal before the 3rd respondent on 22.1.2018. When the same is not disposed of, the present Writ Petition is filed.

As the appeal filed before the 3rd respondent is pending, this Writ Petition is disposed of directing the 3rd respondent to consider the said appeal and pass appropriate orders in accordance with law, within two months from the date of receipt of a copy of this order, if no order was passed already. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
