THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7860 OF 2017 ORDER:
The grievance of the petitioners herein in the present writ petition is non-consideration of the application dated 15.02.2003 and the reminder dated 31.10.2015, said to have been submitted by the petitioners herein under Section 28-A of Land Acquisition Act, 1894, praying for enhancement of compensation in terms of the reference ordered by the Civil Court in O.P.No.135/1992 and batch, dated 01.11.2002. 2.
It is submitted by the learned counsel for the petitioners that the Land Acquisition Officer passed an award on 05.08.1990 and on an application made by certain land owners, covered by the same notification, the matter was referred to Civil Court under Section 18 of the Land Acquisition Act.
The same was numbered as O.P.No.135/1992 and batch and the Civil Court, answered the said reference on 01.11.2002. It is further submitted by the learned counsel for the petitioners that on coming to know about the reference answered by the Civil Court, petitioners applied for certified copy of the order of reference on 04.11.2002 and the same was made available to the petitioners on 03.12.2002 by the Civil Court and on 15.02.2003, the petitioners herein made an application for
AVSS,J W.P.No.7860 of 2017 extension of benefits to the petitioners under Section 28-A of the Land Acquisition Act.

Since the said application dated 15.02.2003 is pending consideration before the respondents herein, taking into consideration the submissions of the learned counsel for the petitioners and learned Government Pleader, this Court is of the considered opinion that the ends of justice would be served, if the respondents are directed to take appropriate action on the representation dated 15.02.2003, submitted by the petitioner herein within a timeframe.

For the aforesaid reasons, this writ petition is disposed of, directing the respondents herein to pass appropriate orders on the representation dated 15.02.2003, said to have been submitted by the petitioners herein under Section 28-A of the Land Acquisition Act, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
