HACJ&ARR,J WP.NO.8271 of 2019 ORDER: (Per the Hon'ble the Acting Chief Justice Raghvendra Singh Chauhan) The petitioner, Smt. Shashi Roshan, has filed the present petition, ostensibly, on the ground that on 16.04.2019, the detenue, Smt. T. Soundarya Sravanthi, W/o. T. Praveen Kumar Raj, was picked up by the police, and her whereabouts are unknown ever since then.

Mr. A. Manoj Kumar, the learned Assistant Government Pleader for Home, submits that on 18.03.2019, an F.I.R. was lodged by the prosecutrix, wherein she alleged that the detenue's husband, Mr. T. Praveen Kumar Raj, has repeatedly committed rape upon her; and both the detenue and her husband have blackmailed her by having her nude photographs and videos. It is in consequence of the said F.I.R. that the detenue was picked up by the police and produced before the concerned Magistrate. The learned Magistrate has ordered that the detenue should be sent to judicial custody. Thus, according to the learned Assistant Government Pleader, the custody of the detenue is a legal one and not an illegal one. In order to buttress this plea, the learned Assistant Government Pleader has submitted documents clearly showing that the detenue is presently in judicial custody. Since the detenue is in judicial custody, the custody cannot be said to be an illegal one.

Therefore, this Court does not find any merit in the present Habeas Corpus Petition; it is hereby dismissed. There shall be no order as to costs.
