THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE K.LAKSHMAN CONTEMPT CASE No.774 OF 2019 ORDER: (per SK,J) This contempt case was instituted alleging willful disobedience to the order dated 19.12.2018 passed in Writ Appeal No.844 of 2012. By the said order, the Road Transport Corporation was directed to consider the case of the appellant/writ petitioner for contract appointment as a driver on the strength of his fresh genuine driving licence and subject to his being medically fit for such contractual appointment. Pursuant to the aforestated order, the Regional Manager, Ranga Reddy Region, Telangana State Road Transport Corporation, issued proceedings dated 09.05.2019 holding that the petitioner could not be considered for appointment as a driver on contract basis as he had already attained the age of superannuation on 31.01.2018. 2.

Though Sri P.Venkateswar Rao, learned counsel for the petitioner, would contend that this aspect requires to be looked into, we are of the opinion that the disputed age of the petitioner would not figure for consideration in this contempt case arising out of the order passed in Writ Appeal No.844 of 2012. That litigation had no concern with the age of the petitioner, whereby that issue can now be looked into by this Court in exercise of contempt jurisdiction. 3.

The contempt case is accordingly dismissed on this short ground leaving it open to the petitioner to assail the proceedings dated 09.05.2019 in accordance with law by way of independent proceedings, if so advised. No order as to costs.
