HONOURABLE SRI J USTICE SURESH K UMAR K AIT CIVIL REVISION PETITION No. 5745 of 2016 ORDER:

Vide present Civil Revision Petition, the petitioner seeks a direction thereby directing the Executing Court to pass orders in EA.No. 19 of 2008 in E.P.No.72 of 2003 in O.S.No.36 of 2001. Learned Counsel appearing on behalf of the petitioner submits that though no order staying the operation of the judgment dated 28.03.2014 in Second Appeal No. 677 of 201 is passed by the Supreme Court in the appeal preferred against the said judgment in SLP (Civil) No.18782 of 2014, the Executing Court is not disposing of EA.No.19 of 2008 on the ground that the said SLP is pending. Having heard the learned Counsel for the petitioner and perused the material on record, the Civil Revision Petition is disposed of directing the Executing Court to dispose of EA.No.19 of 2008 in EP.No. 72 of 2003 in OS.No.

36 of 2001, on merits and in accordingly with law, as expeditiously as possible, if there is no stay order passed by the Supreme Court in SLP(Civil)No. 18782 of 2014. Miscellaneous petitions pending consideration if any in the Civil Revision Petition shall stand closed in consequence. No order as to costs.
