O R D E R

This petition is filed under Section 438 of Cr.P.C. seeking release of the petitioner, who is accused No.7, in the event of his arrest in Crime No.39/2016 of Palamaner Police Station, Chitoor District, registered for the offences punishable under Sections 197, 198, 464, 465, 466, 467, 468, 471, 472, 473, 474, 475 and 42 read with 34 IPC.

The allegations are that the accused Nos.1 and 2 in the said crime created false surety solvencies with fake rubber stamps and forged the signatures for earning money. The petitioner, who is A-7 urges that based on the confessions of the said accused, he has been falsely implicated in the crime.

The learned counsel for the petitioner submitted that the principal accused Nos. 1 and 2 were granted bail by this court in Crl.P.No.8142/2016 dated 17.6.2016 and A-4 was granted bail in Crl.P.No.9804/2016. Since the petitioner stands on same footing, seeks the relief. The leaned Public Prosecutor opposed the same. As per the submissions of the leaned counsel for the petitioner/A-7, the other accused 1, 2 and 4 were granted bail and anticipatory bail by this court and the petitioner also stands on the same footing. Hence, I am inclined to grant anticipatory bail to the petitioner.

The petitioner shall surrender before the Station House Officer, Palamaner Police Station, Chittoor District. On such appearance, the petitioner shall be released on bail on his executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties of like sum to the satisfaction of the said Station House Officer. The petitioner shall report before the Station House Officer as and when required. The criminal petition is accordingly allowed.
