Nallakunta Hyderabad The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of C HARI PREETH Advocate for the Petitioner, THE PUBLIC PROSECUTOR for the Respondent and the Court made the following.

ORDER

\ THE HON'BLE SRI JUSTICE SANJAY KUMAR CRIMINAL PETITION No.2125 of 2O19 ORDER:

The petitioner is the sole accused in Crime No.47 of 2019 on the file of Nallakunta Police Station, Hyderabad, registered under Sections 406,419,420, 468 and 471IPC. By way of this petition, he seeks grant of anticipatory bail under Section 438 Cr.P.C.

The allegation against the petitioner-accused is that he continued to draw family pension in the name of his mother long after she expired and illegally withdrew such family pension amounts to the tune of Rs.10,87,667l-.

Sri C.Hari Preeth, learned counsel for the petitioner-accused, however informed this Court that the petitioner-accused already returned a sum of Rs.12,00,22U- on 28.06.2018 and a sum of Rs.2,94,3631- on 25.01.2019.

Learned Assistant Public Prosecutor, State of Telangana, would concede that the petitioner-accused did, in fact, return the aforestated sums but his interrogation would be necessary for achieving further progress in the investigation.

In the light of the aforestated facts, this Court is of the opinion that the petitioner-accused may be granted anticipatory bail subject to some conditions.

The criminal petition is accordingly allowed. In the event of arrest of the petitioner-accused in Crime No.47 of 2019 on the file of Nallakunta Police Station, Hyderabad, he shall be enlarged on bail upon his furnishing a personal bond for.a sum of Rs.20,000/- (Rupees Twenty Thousand only) along with two sureties for a like sum each to the satisfaction of the Station House Officer, Nallakunta Police Station, Hyderabad. In addition

thereto, the petitioner-accused shall abide by the conditions prescribed in Section 438(2) Cr.P.C. and also report before the Station House Officer, Nallakunta Police Station, Hyderabad, between 10.00 AM and 11.00 AM on every Monday and Wednesday until the filing of the charge sheet.
